Centura Zal\u0103ului"},"content":{"rendered":"<p style=\"text-align: justify;\">Prin Hot\u0103r\u00e2rea de Guvern nr. 736\/31.08.2020 a fost declan\u015fat\u0103 procedura de expropriere pentru proiectul \u201eVarianta de ocolire a municipiului Zal\u0103u, etapa 2, intre DN1F, km 79+625 \u2013 DJ 191C\u201d \u015fi a fost aprobat\u0103 lista cuprinz\u00e2nd cele <strong>123 imobile<\/strong> ce <strong>vor fi supuse exproprierii<\/strong> conform amplasamentului final, <strong>\u00een suprafa\u0163\u0103 total\u0103 de<\/strong> <strong>272.324 metri p\u0103tra\u021bi de teren<\/strong>.<\/p>\n<p style=\"text-align: justify;\">\u00cen Anexa nr. 2 la HG nr. 736\/2020 sunt indicate numele proprietarilor \u015fi sumele individuale estimate de expropriator pentru desp\u0103gubirea acestora, \u00een cuantum total de 860.284 lei, ceea ce \u00eenseamn\u0103 c\u0103 <strong>statul rom\u00e2n va oferi, \u00een medie, 3 lei \u0219i 15 bani pentru un metru p\u0103trat de teren, adic\u0103 de aprox. 20 de ori mai pu\u0163in dec\u00e2t valoarea real\u0103 a imobilelor expropriate.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><em>Anexa nr. 2<\/em><\/strong><em> poate fi accesat\u0103 aici: <a href=\"http:\/\/cluj.cnadnr.ro\/sites\/default\/files\/exproprieri\/HOT%C4%82R%C3%82RE%20nr.%20736%20din%2031%20august%202020.pdf\">http:\/\/cluj.cnadnr.ro\/sites\/default\/files\/exproprieri\/HOT%C4%82R%C3%82RE%20nr.%20736%20din%2031%20august%202020.pdf<\/a>.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Proprietarii care nu sunt de acord cu sumele stabilite de expropriator \u00een compensa\u0163ie au posibilitatea s\u0103 \u00eentroduc\u0103 o cerere de chemare \u00een judecat\u0103 la Tribunalul S\u0103laj, prin care s\u0103 conteste valoarea desp\u0103gubirilor \u015fi s\u0103 solicite at\u00e2t stabilirea acestora de c\u0103tre instan\u0163\u0103 &#8211; la valoarea de pia\u0163\u0103, c\u00e2t \u015fi obligarea expropriatorului la plat\u0103, \u00eens\u0103 doar ulterior emiterii deciziei de expropriere \u015fi consemn\u0103rii sumelor aferente desp\u0103gubirilor, respectiv dup\u0103 finalizarea celei de a treia etape a procedurii. <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Prima etap\u0103: <\/strong>majoritatea proprietarilor ce de\u0163in terenuri pe coridorul de expropriere au primit deja o notificare din partea CNAIR prin care au fost informa\u0163i despre inten\u0163ia de expropriere \u015fi au fost invita\u0163i s\u0103 se prezinte la sediul expropriatorului, \u00een termen de 20 de zile, pentru a depune actele care atest\u0103 dreptul lor de proprietate asupra imobilului.<\/p>\n<p style=\"text-align: justify;\">Dac\u0103 v\u0103 num\u0103ra\u0163i printre proprietarii viza\u0163i (<em>pute\u0163i verifica acest lucru \u00een Anexa nr. 2 la HG nr. 736\/2020 &#8211; acces\u00e2nd link-ul de mai sus<\/em>), trebuie s\u0103 \u015fti\u0163i c\u0103 nu sunte\u0163i obliga\u0163i s\u0103 v\u0103 deplasa\u0163i la sediul expropriatorului, indiferent dac\u0103 a\u0163i fost sau nu notifica\u0163i \u00een acest sens, ci ave\u0163i posibilitatea de a transmite documentele care atest\u0103 dreptul dvs. de proprietate asupra imobilelor supuse exproprierii prin po\u015ft\u0103, e-mail sau fax.<\/p>\n<p style=\"text-align: justify;\"><strong>A doua etap\u0103: <\/strong>\u00een perioada urm\u0103toare vor fi consemnate la CEC, pe numele proprietarilor expropria\u0163i, sumele individuale reprezent\u00e2nd plata desp\u0103gubirilor.<\/p>\n<p style=\"text-align: justify;\">\u00cen vederea eliber\u0103rii acestor sume, persoanele \u00eendrept\u0103\u0163ite la desp\u0103gubiri trebuie s\u0103 formuleze o cerere c\u0103tre expropriator con\u0163in\u00e2nd numele \u015fi prenumele, adresa de domiciliu \u015fi actele doveditoare referitoare la existen\u0163a dreptului de proprietate asupra imobilului expropriat.<\/p>\n<p style=\"text-align: justify;\">Inclusiv personele ce se consider\u0103 nedrept\u0103\u0163ite de cuantumul desp\u0103gubirii pot cere plata sumei deja stabilite, urm\u00e2nd ca ulterior, \u00een situa\u0163ia stabilirii unui cuantum superior prin hot\u0103r\u00e2re judec\u0103toreasc\u0103 definitiv\u0103, expropriatorul s\u0103-i elibereze doar diferen\u0163a dintre desp\u0103gubirea stabilit\u0103 de instan\u0163\u0103 \u015fi desp\u0103gubirea stabilit\u0103 de expropriator.<\/p>\n<p style=\"text-align: justify;\">Plata efectiv\u0103 c\u0103tre persoanele expropriate se face \u00een termen de cel mult 90 de zile de la emiterea deciziei de stabilire a cuantumului desp\u0103gubirilor.<\/p>\n<p style=\"text-align: justify;\">Ministrul Transporturilor a anun\u0163at deja, \u00een data de 29.10.2020, c\u0103 a semnat cu CNAIR contractul de finan\u021bare pentru proiectul \u201eVarianta de ocolire a municipiului Zal\u0103u, etapa 2, intre DN1F, km 79+625 &#8211; DJ 191C\u201d, \u00een valoare total\u0103 de 240.466.412,05 lei.<\/p>\n<p style=\"text-align: justify;\"><strong>A treia etap\u0103: <\/strong>dup\u0103 consemnarea desp\u0103gubirilor la CEC pe numele proprietarilor expropria\u0163i vor fi emise deciziile de expropriere, ce constituie titlu executoriu pentru predarea terenului \u015fi \u00een baza c\u0103rora va avea loc transferul dreptului de proprietate de la de\u0163in\u0103torii terenurilor la expropriator.<\/p>\n<p style=\"text-align: justify;\"><strong>A patra etap\u0103:<\/strong> finalizarea formalit\u0103\u0163ilor aferente procedurii de expropriere, respectiv \u00eentocmirea noilor documenta\u0163ii cadastrale de c\u0103tre expropriator.<\/p>\n<p style=\"text-align: justify;\"><strong>Concluzii:<\/strong><\/p>\n<p style=\"text-align: justify;\">Persoanele nemul\u0163umite de cuantumul desp\u0103gubirilor au deschis\u0103 calea instan\u0163elor de judecat\u0103, iar <strong>ac\u0163iunile pot fi formulate \u00een termen de maxim de 3 ani de zile \u015fi sunt scutite de la plata taxelor judiciare de timbru. <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Desp\u0103gubirea acordat\u0103 de instan\u0163\u0103 nu poate fi mai mic\u0103 dec\u00e2t cea oferit\u0103 de expropriator \u015fi nici mai mare dec\u00e2t cea solicitat\u0103 de reclamant \u2013 proprietarul expropriat.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Desp\u0103gubirile oferite de stat sunt gre\u015fit stabilite deoarece au la baz\u0103 valorile minime din grilele notariale.
